This bill mandates that all rules and regulations established by the State Board of Education require legislative approval before they can be adopted, amended, or readopted. Specifically, the bill outlines that actions taken by the State Board on or after the effective date of this legislation must receive approval through a concurrent resolution from the Legislature. This includes the adoption, amendment, or repeal of any rule or regulation, as well as the readoption of expiring rules, whether with or without changes. The State Board is also required to submit the proposed rules to the Legislature, which will then decide to approve or disapprove them. If approved, the rules must be adopted in accordance with the Administrative Procedure Act.
In addition to the requirement for legislative approval, the bill repeals the entirety of the "Managing for Equity in Education" regulations found in chapter 7 of Title 6A of the New Jersey Administrative Code, rendering them null and void. This means that these regulations will no longer have any legal effect following the enactment of this bill. The bill aims to increase legislative oversight over the State Board's rule-making process while eliminating existing equity regulations.
