This bill allows graduating students from public and nonpublic schools, institutions of higher education, and proprietary institutions licensed to offer academic degrees to request that their diplomas reflect their preferred names. Importantly, students will not be required to provide legal documentation to demonstrate a legal name or gender change in order to use a preferred name. However, schools and institutions retain the right to deny requests for preferred names if they are intended to misrepresent identity, avoid legal obligations, harm the institution's reputation, or are deemed derogatory or inappropriate.

Additionally, the bill mandates that schools and institutions update a former student's records when sufficient documentation is provided to demonstrate a legal name or gender change. Acceptable forms of documentation include a state-issued driver's license, birth certificate, passport, social security card, or court order. Upon receiving this documentation, schools and institutions are required to reissue any documents, such as transcripts or diplomas, with the updated legal name or gender, although they may charge a nominal fee for this service.
