This bill amends Section 12 of P.L.1998, c.1 (C.2A:17-56.61) to expand employer reporting requirements to include not only traditional employers and labor organizations but also other entities that employ or contract with individuals for financial compensation. This includes technology platforms used for ride-sharing and delivery services. The bill mandates that these entities report to the Department of Human Services within 20 days of hiring, re-hiring, or contracting with any individual, with specific details required such as the individual's name, address, date of birth, and Social Security number, as well as the employer's information.
Additionally, the bill introduces a provision for civil penalties for non-compliance, starting with a written warning for the first violation and escalating to fines of up to $25 per violation, or $500 if the failure to report is due to a conspiracy to provide false or incomplete information. The penalties are payable to the State Treasurer and can be recovered through legal proceedings. The information collected will also be shared with relevant state and federal agencies involved in employment security and workers' compensation programs. The act is set to take effect immediately upon passage.
