This bill aims to prohibit the sale of certain products that utilize advertisements linking them to controlled dangerous substances or their analogs. Specifically, it makes it unlawful for any person to sell or offer for sale merchandise that directly or indirectly alludes to such substances, particularly targeting food, beverages, or products intended for ingestion or inhalation. The bill also restricts the sale of these products to individuals under 18 years of age. However, it clarifies that these provisions do not apply to prescription medications dispensed by a pharmacist with a valid prescription.
Violations of this bill would be classified as unlawful practices under the consumer fraud act, which carries significant penalties. First-time offenders could face fines of up to $10,000, while subsequent offenses could result in fines of up to $20,000. Additionally, the Attorney General may issue cease and desist orders, and violators could be subject to punitive damages, as well as treble damages and costs awarded to the injured parties. The bill is set to take effect on the first day of the third month following its enactment.
