This bill amends existing law to prohibit emergency homeless shelters from requiring individuals seeking shelter to be enrolled in any local, State, federal, or private assistance programs as a condition for receiving shelter for a minimum of 72 hours. The bill ensures that individuals or families can access shelter without preconditions related to program enrollment. After the initial 72-hour period, shelters may require individuals to begin the application process for assistance programs as a condition for continued shelter, with a guarantee of at least 90 days of shelter for those who comply.

Additionally, the bill clarifies that shelters are not obligated to exceed their licensed capacity, including any authorized excess capacity, to meet these requirements. It also maintains that shelters can refuse service if such refusal is permitted by existing laws or regulations. Overall, the legislation aims to enhance access to emergency shelter for homeless individuals while balancing the operational capacities of the shelters.
