This bill authorizes the Secretary of Higher Education to impose a $10,000 fine on institutions of higher education that do not adequately respond to and investigate allegations of sexual assault made by students against other students. The bill mandates that if the Secretary determines that an institution has failed in its duty, appropriate disciplinary action must also be taken against the perpetrator if the allegation is substantiated.

Additionally, the bill outlines that the civil penalty will be collected and enforced through summary proceedings in accordance with the Penalty Enforcement Law of 1999. The act is set to take effect immediately upon passage.
