The requirement is triggered when a recall necessitates that consumers stop using or return the device. Additionally, the bill classifies any failure to adhere to these requirements as an unlawful practice under New Jersey's consumer fraud act, which carries penalties of up to $10,000 for first offenses and $20,000 for subsequent offenses. Violators may also face cease and desist orders, punitive damages, and the potential for treble damages and costs awarded to affected consumers.
