This bill mandates that transportation network companies (TNCs) require applicants to disclose their history with other TNCs, including any past investigations or disciplinary actions related to sexual misconduct. Specifically, applicants must provide a written statement detailing any sexual misconduct investigations they have faced while working as a TNC driver, unless those allegations were found to be false or unsubstantiated. Furthermore, TNCs are authorized to ban drivers from accessing their digital networks during ongoing investigations into sexual misconduct allegations or if an investigation concludes that the driver engaged in such misconduct. In cases where findings are inconclusive or allegations are not substantiated, TNCs can still choose to prohibit the driver based on the overall circumstances.

Additionally, the bill requires TNCs to notify all registered TNCs in the state of any sexual misconduct allegations against a driver, along with updates on the investigation's status and outcomes. It also stipulates that the Attorney General must approve the methods used by TNCs for conducting criminal background checks, which must include a mechanism for timely notifications regarding any subsequent arrests or convictions of drivers after their initial background check. This aims to enhance safety and accountability within the TNC industry by ensuring that companies are informed of any potential risks associated with their drivers.
