This bill mandates that State-funded construction projects utilize plastic construction materials containing specified amounts of postconsumer recycled content. Specifically, it requires that such materials contain at least 10 percent postconsumer recycled content for purchases made within the first two years following the bill's enactment, and at least 15 percent thereafter. The bill defines "plastic construction material" as any construction material made of more than 50 percent plastic, measured by cost, and outlines the criteria for what constitutes a "State-funded construction project."

Additionally, the bill includes provisions for exemptions from these requirements if the use of compliant plastic construction materials would increase the overall project cost by 25 percent or if such materials are unavailable in sufficient quantities for the intended application. The Commissioner of Environmental Protection is tasked with adopting necessary rules and regulations to implement the act, which is set to take effect immediately upon passage.
