This bill repeals sections 1 through 9 of P.L.2020, c.117, which previously prohibited certain establishments from providing or selling various single-use products, including plastic carryout bags, paper carryout bags, polystyrene foam service products, and plastic straws. The repeal allows stores and food service businesses to again provide and sell these single-use products to customers, including food banks and food pantries. Additionally, it removes penalties for noncompliance and disbands the Plastics Advisory Council established under the previous law, along with the requirement for the Department of State to assist businesses in compliance.

Furthermore, the bill amends section 5 of P.L.2002, c.128 (C.13:1E-217) to reflect the repeal by deleting specific language that was added in P.L.2020, c.117. This amendment ensures that the Clean Communities Program Fund continues to operate without the constraints imposed by the now-repealed law. Overall, the bill aims to ease restrictions on single-use products, thereby allowing their use in various establishments across the state.
