This bill regulates the use of artificial intelligence (AI) in video interviews during the hiring process in New Jersey. It mandates that employers notify applicants prior to the interview that AI may be used to analyze their video submissions and requires them to provide information on how the AI functions and the characteristics it evaluates. Employers must also obtain written consent from applicants to use AI for evaluation, and they are prohibited from using AI on applicants who do not consent. Additionally, the bill restricts the sharing of applicant videos to only those service providers necessary for evaluation and requires employers to delete all copies of an applicant's video upon request within 30 days.

Furthermore, the bill requires employers using AI analysis to collect and report demographic data regarding the race and ethnicity of applicants who are and are not selected for in-person interviews, as well as those who are hired. This data must be reported annually to the Department of Labor and Workforce Development, which will analyze it for potential racial bias in AI usage and report findings to the Governor and Legislature. The bill also establishes civil penalties for violations, with fines of $500 for first offenses and $1,000 for subsequent offenses.
