This bill mandates that all public and nonpublic schools in New Jersey must have at least one portable anti-choking device available in key locations such as the cafeteria and the school nurse's office. These devices, which are defined as portable medical devices that use manually created suction to clear airway blockages during choking emergencies, must be registered with the United States Food and Drug Administration as Class II acute upper-airway obstruction devices. The devices are to be placed in unlocked and easily accessible locations during school hours and at school-sponsored events, with appropriate signage indicating their locations.

Additionally, the bill requires each school board to develop policies for the use of these devices, which must include training for school nurses and employees in airway management and the proper use of the devices. The Commissioner of Education is tasked with providing annual training opportunities for school staff, and the Department of Education will reimburse schools for the costs associated with implementing these requirements. The bill is set to take effect 180 days after enactment, although the Commissioner may take necessary administrative actions beforehand to ensure timely implementation.
