This bill mandates that courts order financial support for a minor child if the child's parent or guardian is killed by a drunk driver convicted of reckless vehicular homicide. The new legal language specifies that the court must consider various factors when determining the amount of financial support, including the child's financial needs, the resources of the surviving parent or guardian, and the child's standard of living and educational needs. The support must continue until the child reaches 18 years of age or graduates from high school, whichever is later, or until the child turns 21 if they have a mental or physical disability. Additionally, the financial support obligation is set for a minimum of five years.

The bill also outlines procedures for payment, requiring defendants to make payments to the court clerk, who will then remit the funds to the surviving parent or guardian. If a defendant is incarcerated and unable to make payments, the obligation will accrue during their incarceration, with a one-year grace period post-release to begin payments. Furthermore, if there are any arrears at the end of the support period, the court will mandate continued payments until the debt is settled. Lastly, any civil judgments against the defendant related to the same incident will be offset by the financial support payments ordered by the court.
