This bill introduces new provisions regarding the crime of carjacking in New Jersey. It mandates that courts impose monetary bail for individuals charged with carjacking, requiring the bail amount to be at least equal to the value of the motor vehicle involved in the alleged crime. If the individual is charged with both carjacking and eluding a law enforcement officer, the bail must be set at an amount at least equal to twice the value of the vehicle.
Additionally, the bill stipulates that juveniles aged 15 and older, who are alleged to have committed carjacking, will be tried as adults. The prosecutor can file a motion to waive jurisdiction from the Family Part to an appropriate court, provided there is probable cause to believe the juvenile committed the act. The bill also amends existing law by removing carjacking from the list of offenses that do not require a waiver of jurisdiction for juveniles, thereby allowing for more serious legal consequences for young offenders involved in such crimes.
