The "Volunteer Medical Professional Health Care Act" aims to address the healthcare needs of uninsured residents in New Jersey by providing civil immunity to certified volunteer medical professionals, specifically physicians and dentists, who offer their services at nonprofit free clinics. To be certified, these professionals must be licensed in New Jersey, recognized as employees of the federal Public Health Service, and demonstrate a commitment to providing qualifying health services by working a minimum of four hours per week at a free clinic for four consecutive weeks. To maintain their certification, they must continue to meet these criteria and provide at least 48 hours of qualifying health services each calendar quarter.
The bill stipulates that certified volunteer medical professionals are immune from civil liability for personal injury or wrongful death resulting from their care, provided it was given in good faith and within the scope of their practice, with exceptions for gross negligence or willful misconduct. Additionally, any claims for damages must be directed against the State in a competent court. The Commissioner of Health is tasked with adopting necessary regulations to implement the act, which will take effect seven months after enactment, although anticipatory actions may be taken beforehand.
