This bill establishes that public officers or employees convicted of certain crimes or found at fault in civil actions will be held liable for the costs associated with their legal representation and prosecution. Specifically, individuals who are convicted of crimes related to their office or employment will owe costs to the Attorney General, county prosecutor, or United States Attorney, as applicable. Additionally, if they receive public legal representation, they will be responsible for reimbursing the public entity that covered those costs, with the exception of representation by the Office of the Public Defender unless recoverable under existing law. The bill also stipulates that those found at fault in civil matters will similarly be liable for the costs of their public legal representation.

Furthermore, the bill allows for the garnishment or attachment of retirement benefits or pension contributions of individuals who are liable for legal expenses or judgments related to offenses involving theft or misuse of public funds. It mandates that the Division of Pensions and Benefits in the Department of the Treasury seek confirmation from the Internal Revenue Service regarding the qualification status of State-administered retirement systems under federal law. If the IRS determines that the bill alters the qualification status, the relevant provisions regarding garnishment will become void.
