This bill amends P.L.2021, c.498, to permanently extend provisions allowing retired members of the Public Employees Retirement System (PERS) to return to employment with the Legislature under specific conditions. The current law permits these retirees to return for a term of up to four years, provided they meet certain criteria, including a minimum 30-day gap after retirement and part-time employment of no more than 20 hours per week. The bill modifies this term limit, increasing it from four years to seven years, and allows those who returned to employment under the previous law to extend their term to seven years as well.
Additionally, the bill removes the stipulation that only former employees of the Legislature who were granted a retirement allowance prior to or on January 18, 2021, or during the years 2022, 2023, or 2024, are eligible to return to employment. This change broadens the eligibility for retired members of PERS to return to the Legislature, while still maintaining that the retirement must be bona fide and not prearranged. The bill is set to take effect immediately upon passage.
