This bill mandates that the owner of a parking structure must hire a professional engineer to inspect the structural integrity of the parking structure at least once every five years. The inspections are intended to ensure compliance with the structural integrity specifications for the intended loads and uses of the structure. Following each inspection, the professional engineer is required to provide a report to the owner within 30 business days. The owner must then submit a copy of this report to the Department of Community Affairs (DCA) within 14 days of receiving it. The DCA is tasked with identifying which parking structures are subject to these requirements and notifying owners who have not submitted their reports.
Additionally, the bill grants the DCA the authority to close a parking structure if it fails inspection or if the owner does not submit the required report within the specified timeframe. The DCA must allow a 30-day grace period for owners to submit their reports after notification. If a structure is closed, it can be reopened only after the DCA receives a report from a professional engineer confirming that the structure has passed the required inspection. The Commissioner of Community Affairs is also directed to adopt rules and regulations to implement the provisions of this bill within four months of its enactment.
