This bill amends New Jersey's cyber-harassment law (N.J.S.A.2C:33-4.1) to expand the definition of cyber-harassment to include online communications made with reckless disregard for the safety of another individual. The bill specifies that a person can be charged with cyber-harassment if they make communications online with the intent to harass or with reckless disregard for another's safety. Additionally, it includes provisions for knowingly sending lewd, indecent, or obscene material with the intent to emotionally harm a reasonable person or instill fear of physical or emotional harm.

Under the new provisions, cyber-harassment committed with reckless disregard is classified as a disorderly persons offense, while cyber-harassment committed purposely or intentionally remains a crime of the fourth degree, escalating to a third-degree crime if the perpetrator impersonates a minor. The bill also outlines potential penalties, including imprisonment and fines, and establishes conditions for minors adjudicated delinquent for cyber-harassment, which may include mandatory classes or training programs. Furthermore, it holds parents or guardians accountable for failing to supervise minors who engage in such behavior.
