This bill aims to prohibit the sale of all tobacco products and electronic smoking devices at pharmacies in New Jersey, as well as at any business that has a pharmacy located on its premises. The legislation establishes civil penalties for violations, starting at $250 for the first offense, escalating to $500 for the second, and $1,000 for any subsequent violations. Additionally, pharmacies and businesses that violate this prohibition may face disciplinary actions from relevant regulatory bodies. The bill also clarifies that it does not apply to department stores or food retailers that operate a pharmacy practice site or lease space for one.
Importantly, the bill allows for the sale of smoking cessation products approved by the federal Food and Drug Administration and permits pharmacies with a medical cannabis dispensary permit to dispense medical cannabis and related supplies to registered patients. The definitions of "department store" and "food retailer" are included to delineate the types of establishments that are exempt from these restrictions. The bill is set to take effect on the first day of the seventh month following its enactment.
