This bill aims to impose stricter penalties for individuals convicted of fifth or subsequent drunk driving offenses in New Jersey. Under the proposed legislation, such offenses would be classified as a crime of the third degree, which carries potential penalties of up to $15,000 in fines and imprisonment for three to five years. Additionally, the bill stipulates that individuals convicted of these offenses would forfeit their right to operate a motor vehicle for 10 years. However, if the offense occurs in a school zone or near a school crossing, the suspension period would increase to 20 years.

Furthermore, the bill mandates that individuals convicted under this section must comply with various requirements set by the Division of Mental Health and Addiction Services, including screening, evaluation, and participation in educational programs related to alcohol and drug use. Failure to meet these requirements would result in a mandatory two-day jail term and continued driver license revocation until compliance is achieved. A fee of $100 would also be imposed to support the Intoxicated Driving Program Unit. The act is set to take effect immediately and will apply to offenses committed on or after the effective date.
