This bill amends the provisions of P.L.2021, c.498, allowing retired members of the Public Employees Retirement System (PERS) who were previously employed by the Legislature to return to work under specific conditions. Currently, these individuals can return for a term of up to four years, provided they meet certain criteria, including a minimum 30-day gap after retirement, having reached the applicable service retirement age, and working no more than 20 hours per week as part-time employees. The bill extends this return period from four years to seven years, thereby providing greater flexibility for retired members wishing to re-enter the workforce.
Additionally, the bill allows those who have already returned to employment under the existing law to extend their term from two years to seven years from the date of their return. It maintains the stipulation that the retirement must be bona fide and that any reemployment cannot be prearranged prior to retirement. The legislation does not apply to former members of the Legislature themselves. The bill is set to take effect immediately upon passage.
