This bill proposes a supplemental appropriation of $25 million from the General Fund to the Department of Health (DOH) for Hudson Regional Health, specifically to support Heights University Hospital. The funds are intended to ensure the continuous operation of the hospital, which has indicated that it may need to suspend non-essential services without financial assistance. The bill outlines specific conditions that Hudson Regional Health must adhere to in order to receive these funds, including maintaining hospital operations, providing quarterly financial reports to the DOH, appointing a State representative to the hospital's governing body, and ensuring compliance with employee protection provisions in the event of a change in control.
Additionally, the bill establishes a reimbursement structure for Hudson Regional Health in the event that Heights University Hospital ceases to provide services within seven years of receiving the funds. The reimbursement amounts decrease over time, starting at 100% if the violation occurs within three years, down to 20% if it occurs in the seventh year. The bill also requires Hudson Regional Health to waive any defenses related to its status as a limited liability entity to fulfill its repayment obligations. Furthermore, if the organization needs to transfer any assets, it must offer the State, county, or municipality the right of first refusal to acquire those assets.
