This bill mandates that owners of solar and photovoltaic energy generation facilities and structures are responsible for the removal and recycling of these facilities, along with any related equipment or infrastructure, once they are no longer in use. The Department of Environmental Protection (DEP) is tasked with developing rules and regulations to ensure compliance with this requirement, which will include minimum standards for the removal and recycling processes. Additionally, the regulations will stipulate that recyclers must securely store any toxic components of solar panels that cannot be safely recycled until a safe recycling method is approved by the DEP.

Violations of this bill or the associated regulations will result in civil penalties of up to $1,000, enforceable through civil action under the "Penalty Enforcement Law of 1999." The bill is set to take effect 180 days after its enactment, although the DEP may begin necessary administrative actions prior to this date to facilitate implementation.
