This bill mandates that data center owners and operators in New Jersey submit semi-annual water and energy usage reports to the Board of Public Utilities (BPU) for a period of three years. The reports must include basic information about the data center, detailed energy and water usage data, and any additional information deemed necessary by the BPU. Data centers that receive financial incentives from state agencies are required to include performance and sustainability indicators, such as energy reuse factor and water usage effectiveness. Data centers that have been operational for at least one year must submit their first report within three months of the bill's enactment, while others have six months to comply.

The BPU is required to publish certain information from these reports on its website within 30 days of receipt, although performance and sustainability data will remain confidential unless anonymized and aggregated from at least five facilities. Additionally, data center operators must notify the BPU of any significant operational changes at least 60 days prior to implementation. After the three-year reporting period, the BPU has the authority to decide whether to make the reporting requirement permanent through the adoption of necessary rules and regulations.
