This bill aims to prohibit the sale, manufacture, and distribution of apparel containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS) in the State of New Jersey, effective two years after the bill's enactment. The definition of "apparel" is broad, encompassing various clothing items intended for regular and formal wear, outdoor apparel, and specific outdoor gear designed for severe wet conditions. Notably, the bill excludes personal protective equipment and military clothing from this definition.

Violations of this prohibition will be classified as unlawful practices under the State's consumer fraud act, P.L.1960, c.39 (C.56:8-1 et seq.), which carries significant penalties. Offenders may face monetary fines of up to $10,000 for a first offense and up to $20,000 for subsequent offenses, along with potential cease and desist orders, punitive damages, and the possibility of treble damages and costs awarded to affected parties.
