This bill establishes protections for faculty and professional staff members of New Jersey City University (NJCU) in the event of a merger with Kean University. It stipulates that for three years following the merger, these employees, who are part of a recognized collective bargaining unit, cannot be subject to termination, layoff, or any adverse employment actions due to the merger. Additionally, any job vacancies resulting from voluntary separations must first be offered to qualified employees who transferred from NJCU to Kean University. Employees will also have two years to meet any new position requirements arising from restructuring, during which they cannot be involuntarily reassigned or terminated for not meeting these new requirements.
The bill ensures that all existing collective bargaining agreements and employment conditions at NJCU remain in effect at Kean University for three years post-merger, and prohibits any actions that would undermine these agreements without mutual consent. It grants the recognized collective bargaining unit the right to enforce these terms through legal means, including seeking injunctive relief for any violations. Furthermore, the bill mandates that all collective bargaining units prior to the merger remain unchanged unless altered through a proper petition. Kean University is also required to implement a transparent communication plan to support affected employees throughout the merger process.
