This bill amends R.S.33:1-10 to enhance the operational capabilities of farm brewery licensees in New Jersey by allowing them to sell their products for consumption both on and off the licensed premises. The new legal language specifies that farm brewery license holders can brew up to 2,500 barrels of malt alcoholic beverages annually and sell these products directly to consumers, as well as offer samples. The bill requires that the brewery be located on land controlled by the licensee, who must be actively engaged in farming, with the beverages produced primarily from ingredients grown on that land. It also maintains that licensees cannot sell food or operate a restaurant on the premises.
In addition to the provisions for farm breweries, the bill introduces new regulations for various alcoholic beverage licenses, including the instructional winemaking facility license, which allows for on-site wine manufacturing for specific purposes and promotional sampling. A graduated fee structure is established for the farm brewery license, ranging from $100 to $300 based on production volume, while other licenses, such as the instructional winemaking facility and cidery and meadery licenses, have set fees of $1,000 and $938, respectively. Overall, this legislation aims to promote local agriculture and the craft beverage industry by enhancing consumer experiences at farm breweries and providing clearer definitions and fee structures for various licenses. The bill is set to take effect immediately upon passage.
