The bill amends R.S.39:4-50 to enhance the Intoxicated Driving Program by imposing additional curriculum requirements for offenders convicted of or initially charged with driving while intoxicated (DWI). It establishes specific penalties for first, second, and third offenses, including fines ranging from $250 to $1,000, detainment periods, and the mandatory installation of ignition interlock devices in vehicles. First offenses incur fines and detainment of 12 to 48 hours, while second offenses require community service. Third offenses result in a $1,000 fine and a minimum of 180 days in jail, with the possibility of reducing the jail term through participation in a substance use disorder rehabilitation program. The bill also allows offenders to voluntarily install ignition interlock devices before conviction and receive a special driver's license notation, as well as credits towards their license forfeiture period for each day the device is installed.
Additionally, the legislation mandates that individuals convicted of DWI and related moving violations complete a qualified online victim impact panel course, which educates offenders on the consequences of driving under the influence through victim testimonies. The course must meet specific requirements, including accessibility and a minimum duration of three and a half hours, with participants receiving a certificate of completion. The bill reinforces existing penalties for DWI offenders, including fines, mandatory detainment in an Intoxicated Driver Resource Center, and potential loss of driving privileges. It also allows courts to order participation in supervised visitation programs at trauma centers or morgues for offenders under 21, aiming to enhance the educational component of the Intoxicated Driving Program and promote accountability among offenders.
