This bill prohibits the practice of forcibly feeding geese, ducks, or other poultry for the production of foie gras, specifically through the use of a tube or other apparatus inserted into the bird's beak, bill, or throat. An exception is made for instances where force feeding is conducted to improve the bird's health. Additionally, the bill prohibits the distribution, sale, or offering for sale of foie gras or any products containing foie gras unless they originate from jurisdictions that also prohibit force feeding practices.
Violators of this bill will receive a written warning for their first offense, while subsequent offenses will incur a civil penalty of up to $100. Each day that a violation continues will be considered a separate offense, and penalties will be enforced by the Secretary of Agriculture through civil action. The bill grants jurisdiction to both the Superior Court and municipal court for the enforcement of these penalties. The provisions of this bill will take effect 60 days after its enactment.
