The Political Donation Transparency Act aims to enhance transparency in political contributions by prohibiting the automatic enrollment of individuals in recurring political donations. Under this bill, candidates and political committees are not allowed to use automatic or recurring contributions in their solicitations unless specific standards are met. These standards require that contributions cannot be set to automatic or recurring by default, must only be established with the affirmative consent of the contributor, and must include a clear description of the contribution's nature, frequency, and amount.
Additionally, the bill grants the Election Law Enforcement Commission the authority to create necessary rules for implementing these provisions. Violators of the act or its associated rules will be charged with a fourth-degree crime, which carries penalties of up to 18 months of imprisonment, a fine of up to $10,000, or both. The act is set to take effect immediately upon passage.
