This bill introduces comprehensive regulations concerning the sale and distribution of products containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS) in New Jersey. It prohibits the sale of various products, including apparel, cosmetics, and food packaging with PFAS, starting three years after the bill's effective date. Additionally, it mandates specific labeling requirements for outdoor apparel designed for severe wet conditions that contains PFAS, requiring a notification of PFAS content. Manufacturers of cookware must disclose the presence of PFAS on labels and cannot claim their products are PFAS-free unless they do not contain intentionally added PFAS.
The bill also restricts the use of Class B firefighting foam containing PFAS for training and testing, permitting its use only in emergencies. To enforce these regulations, the Commissioner of Environmental Protection is empowered to issue orders, impose civil penalties ranging from $1,000 to $20,000 for violations, and notify the public of non-compliance. The maximum civil penalty for ongoing violations is set at $25,000 per day. Overall, the bill aims to mitigate the environmental and health risks associated with PFAS by regulating their use in consumer products and enhancing transparency for consumers regarding these substances.
