These factors include the proposed rent increase amount, the landlord's expenses and profitability, comparisons to similar rental properties in the area, the bargaining positions of both parties, the potential shock to a reasonable person's conscience, the duration since the last rent increase, and the condition of the property, particularly regarding habitability and code violations. Importantly, the burden of proof lies with the landlord to demonstrate that the rent increase is not unconscionable.

Additionally, the bill stipulates that court records related to eviction actions where the tenant prevails will be excluded from public access unless the landlord secures a judgment for possession after a trial. The provisions of this bill do not apply to rent increases that comply with local rent control ordinances or regulations from affordable housing programs. The bill is set to take effect immediately, with the confidentiality provision regarding eviction records commencing six months post-enactment.
