This bill establishes regulations for the administration of medication in community-based residential programs and day programs for individuals with developmental disabilities. It stipulates that no medication can be administered in these settings unless it is done by a nurse or a certified medication aide under the direct supervision of a nurse. The bill also defines key terms such as "community-based residential program," which includes group homes and supervised apartments, and "day program," which refers to certified programs providing habilitation services.
Additionally, the bill requires that individuals under the supervision of a parent or legal guardian who need medication management must not be admitted to these programs without the provision of comprehensive medical documentation from the guardian. This documentation must include specific medication instructions and dosages. Furthermore, if an individual is already participating in a program and their medication or dosage changes, the guardian must provide updated medical documentation to the program's chief nurse to continue participation. The Department of Human Services is authorized to adopt necessary rules and regulations to implement these provisions.
