This bill mandates that State-funded construction projects utilize plastic construction materials containing specified amounts of postconsumer recycled content. Specifically, it requires that plastic construction materials, defined as those made of over 50 percent plastic by cost, must contain at least 10 percent postconsumer recycled content for materials purchased within the first two years following the bill's enactment, and at least 15 percent thereafter. The bill outlines the definitions of key terms such as "construction material," "construction project," and "governmental entity," and establishes that these requirements apply to projects funded in whole or part by the State.
Additionally, the bill includes provisions for exemptions from the recycled content requirements if the use of compliant materials would increase the overall project cost by 25 percent or if such materials are unavailable for the intended application. The Commissioner of Environmental Protection is tasked with adopting necessary rules and regulations to implement the act, which is set to take effect immediately upon passage.
