This bill mandates that all employers in New Jersey verify the employment eligibility of new hires through the E-Verify program, with a phased implementation based on the size of the employer. Employers with 100 or more employees must comply by December 31, 2020, while those with fewer than 100 employees have until December 31, 2021. The bill also establishes a Statewide random auditing program to ensure compliance and outlines procedures for investigating complaints against employers suspected of violating the E-Verify requirement. Civil penalties ranging from $100 to $1,000 may be imposed for violations, with provisions for first-time violators to avoid penalties if they rectify the situation within 72 hours of notification.

Additionally, the bill prohibits the intentional or knowing employment of unauthorized aliens, imposing strict penalties for violations. For a first violation involving knowingly hiring unauthorized aliens, employers face termination of such employment, a three-year probationary period with quarterly reporting, and potential suspension of business licenses if they fail to file a sworn affidavit confirming compliance. For intentional violations, the penalties are more severe, including a five-year probationary period and a minimum ten-day license suspension. A second violation can lead to the permanent revocation of all business licenses held by the employer. The bill is set to take effect on January 1, 2021.
