This bill establishes regulations concerning the sale and use of lithium-ion batteries and certain electric bicycles and scooters in New Jersey. It prohibits the assembly, reconditioning, or sale of lithium-ion batteries that utilize cells from used storage batteries for low-speed electric bicycles, motorized bicycles, low-speed electric scooters, and motorized scooters. Additionally, the bill mandates that these devices and their storage batteries must meet specific safety standards, certified by accredited testing laboratories, before they can be sold, leased, or rented. Violations of these provisions can result in a written warning for the first offense and a civil penalty of up to $1,000 for subsequent violations within a two-year period.

Furthermore, the bill requires businesses that use low-speed electric bicycles or motorized bicycles for commercial purposes to provide fire safety materials to their employees. The Division of Highway Traffic Safety is tasked with developing an informational campaign to educate the public about the fire risks associated with these devices and the necessary safety measures. This campaign will cover both commercial and personal use, focusing on safe purchasing, maintenance, and storage practices. The division is also required to submit annual reports to the Governor and Legislature detailing incidents of fires caused by these devices and evaluating existing fire safety regulations.
