The list will be based on an analysis of state labor market data and direct feedback from employers. It is required to be updated annually and made accessible both as a list and in a downloadable format on the DOLWD's website.
Additionally, the bill stipulates that the DOLWD will adopt rules and regulations in accordance with the Administrative Procedure Act to implement the provisions of this act. The act will take effect 90 days after its enactment, although the Commissioner of Labor and Workforce Development is permitted to take necessary anticipatory administrative actions prior to the official implementation date.
