The bill also defines "negative option features" and outlines specific prohibitions for providers using such features, including the requirement to clearly disclose material terms and obtain express informed consent before charging consumers.

Furthermore, the bill repeals existing law that only applied to health club services and expands the definition of subscription services to encompass all types of subscription providers. Violations of the provisions outlined in the bill are classified as unlawful practices under the consumer fraud act, which can result in significant monetary penalties, cease and desist orders, and potential punitive damages.
