The "Packaging Product Stewardship Act" establishes a comprehensive framework for managing packaging products in New Jersey, emphasizing environmentally sound practices throughout their lifecycle. The act requires producers to either join or create producer responsibility organizations (PROs) to develop stewardship plans that detail strategies for the collection, recycling, and disposal of packaging products. Key targets include a 25% reduction in single-use packaging by 2032, with at least 10% of this reduction coming from reusable products or eliminating plastic components. By 2034, all packaging must be compostable or recyclable, and a minimum recycling rate of 65% must be achieved by 2036. The Department of Environmental Protection (DEP) is responsible for conducting a Statewide needs assessment and setting interim targets to assist producers in meeting these goals.

Additionally, the bill establishes the "Packaging Reduction and Recycling Fund," funded through annual surcharges on PROs and non-participating producers, to support solid waste and recycling infrastructure improvements. Producers are mandated to engage in public outreach and education regarding their stewardship plans, and they must provide educational materials to consumers and retailers. The act also introduces enforcement mechanisms for non-compliance, including civil penalties and legal action, and creates an Office of Plastics and Packaging Management within the DEP to oversee implementation. The Advisory Council on Solid Waste Management's role is expanded to include submitting recommendations for improvements to the state's solid waste management plan, ensuring stakeholder engagement and environmental accountability in managing packaging waste.
