This bill amends current New Jersey law to prohibit sellers from imposing credit card surcharges on customers for transactions occurring within the state. Previously, sellers were allowed to charge a surcharge as long as it did not exceed the actual cost of processing the credit card payment. The bill also introduces new notice requirements for sellers who set a minimum transaction amount for credit card acceptance and for those who offer discounts for payments made by cash, check, or debit card instead of credit card.

Additionally, the bill specifies that sellers must provide clear and conspicuous notice regarding minimum transaction amounts and cash discounts at the point of entry and point of sale, or through electronic means for online transactions. However, it explicitly states that these provisions do not apply to motor fuel retail dealers, who may continue to sell fuel at different prices based on the payment method used. The act is set to take effect immediately upon passage.
