This bill allows individuals diagnosed with traumatic or acquired brain injuries to voluntarily indicate this condition on their driver's licenses or identification cards. The New Jersey Motor Vehicle Commission (MVC) will implement a system where these individuals can have a restriction code displayed on their licenses or IDs, which will assist law enforcement officers and emergency medical professionals in identifying and effectively communicating with them. Additionally, the MVC is required to establish a Statewide automated registry that will store relevant information, such as vehicle registration and emergency contact details, which can be accessed by law enforcement during interactions with these individuals. The information in the registry will be protected from public disclosure, ensuring privacy for those who choose to participate.
Furthermore, the bill mandates the development of a training program for law enforcement officers, created by the Superintendent of the Division of State Police in collaboration with the MVC and the Commissioner of Human Services. This program will focus on identifying and communicating with individuals who have brain injuries, including training in de-escalation techniques. The program will be made available annually to all county and municipal law enforcement agencies in New Jersey. The bill also includes provisions to limit civil liability for the MVC and its employees in certain circumstances, ensuring they are not held liable for issues arising from the registry or interactions with individuals with brain injuries, unless there is evidence of malicious intent or gross negligence.
