This bill mandates that the owner of a parking structure must hire a professional engineer to conduct inspections of the structure's integrity at least once every five years. The inspections are intended to ensure compliance with the structural specifications for the intended loads and uses of the parking structure. Following each inspection, the professional engineer is required to provide a report to the owner within 30 business days. The owner must then submit a copy of this report to the Department of Community Affairs (DCA) within 14 days of receiving it. The bill also requires the DCA to identify which parking structures are subject to these requirements and to notify owners who have not submitted their reports.
Additionally, the DCA is granted the authority to close a parking structure or parts of it if it fails inspection or if the owner does not submit the required report on time. The DCA must allow a 30-day grace period for owners to submit their reports after being notified of their obligations. If a structure is closed, it can only be reopened after the DCA receives a satisfactory report from a professional engineer confirming that the structure has passed the inspection. The bill also instructs the Commissioner of Community Affairs to adopt necessary rules and regulations to implement these provisions.
