The bill also specifies that during a leave of absence, public employers must continue to make contributions to retirement and health care benefits on behalf of the employee. Furthermore, it introduces additional leave entitlements for travel and preparation before military service, as well as a definition of "Federal active duty" that encompasses various forms of military service.
Additionally, the bill mandates that public employers create and maintain written policies and procedures regarding leaves of absence for military members, ensuring uniform application and fair treatment. Employers must acknowledge receipt of documentation related to leave requests and provide timely written communication regarding any issues. If an employer fails to notify an employee within 90 days of a leave request, they are barred from raising any related issues later. The bill also stipulates that all records must be kept for at least 10 years, and if a public employer is found in violation of these provisions, they may be liable for reasonable attorney fees and costs incurred by the employee.
