This bill allows the New Jersey Department of Health to directly procure medical countermeasures, supplies, and therapeutics, overriding existing laws that may restrict such actions. The procurement must comply with federal laws, regulations, or programs and requires approval from the relevant federal department or agency. The Commissioner of Health has the authority to determine the necessity of these purchases for public health and safety.
Additionally, the bill grants the Commissioner of Health the ability to adopt regulations immediately upon filing with the Office of Administrative Law, bypassing the usual procedures outlined in the "Administrative Procedure Act." These regulations will remain effective for up to 18 months, after which the Commissioner can amend, adopt, or readopt them following standard procedures. The act is set to take effect immediately upon passage.
