This bill mandates that retail mercantile establishments in New Jersey that sell gift cards must post a conspicuous notice at or near the location where the gift cards are displayed. The notice is intended to caution consumers about the risks of gift card fraud and provide instructions on what steps to take if they suspect fraud. Additionally, the bill requires these establishments to train their employees on how to identify and respond to gift card fraud, following guidelines established in a related law.

Violations of this new requirement will result in a civil penalty of $1,000, which can be enforced by the Director of the Division of Consumer Affairs. However, such violations will not be classified as unlawful practices under existing consumer protection laws. The bill is set to take effect six months after its enactment, aiming to enhance consumer protection against gift card fraud.
