This bill amends current law to allow the State, local government agencies, and private detention facilities in New Jersey to enter into agreements for the detention of noncitizens for civil immigration violations. Previously, the law prohibited these entities from entering into, renewing, or extending any immigration detention agreements. The bill redefines the terms of such agreements and clarifies that they can now be established under the new provisions.

Specifically, the bill modifies Section 2 of P.L.2021, c.199 (C.30:4-8.16) by removing the prohibition against entering into immigration detention agreements and replacing it with the allowance for such agreements to be made. Additionally, it repeals Section 1 of the same law, which likely contained the previous restrictions. The bill is set to take effect immediately upon passage.
