This bill amends current law to allow the State, local government agencies, and private detention facilities in New Jersey to enter into agreements for the detention of noncitizens for civil immigration violations. Previously, the law prohibited these entities from entering into, renewing, or extending any immigration detention agreements. The bill redefines the terms of such agreements and explicitly permits these actions, thereby reversing the existing restrictions.

Additionally, the bill repeals Section 1 of P.L.2021, c.199, which contained the previous prohibitions. It also removes language that stated nothing in the section would restrict actions contrary to federal or state constitutional law. The bill is set to take effect immediately upon passage.
