This bill amends current law to allow the State, local government agencies, and private detention facilities in New Jersey to enter into agreements for the detention of noncitizens for civil immigration violations. Previously, the law prohibited these entities from entering into, renewing, or extending any immigration detention agreements. The bill redefines the terms of engagement, stating that an "immigration detention agreement" includes any contract or memorandum of understanding that permits the detention of individuals for civil immigration violations.
Additionally, the bill repeals Section 1 of P.L.2021, c.199, which contained the previous restrictions on such agreements. The new legal language inserted into the law allows for the possibility of these agreements, effectively reversing the prior prohibition. The bill is set to take effect immediately upon passage.
