This bill amends the responsibilities of State Contract Managers to include the monitoring of subcontractors that are certified businesses on State contracts. Specifically, the State Contract Manager is tasked with ensuring that these certified subcontractors are performing work within their designated areas of expertise. Throughout the duration of the contract, the State Contract Manager must routinely document the use of these subcontractors. If a prime contractor decides to stop using a certified business as a subcontractor, the State Contract Manager is required to obtain a formal explanation for this change.
Additionally, the bill mandates that State Contract Managers report quarterly to the Chief Diversity Officer on instances where certified businesses are engaged in work outside their expertise. This report must detail the prime contractor's name, the nature of the subcontractor's work, and how it deviates from their identified area of expertise. The bill also defines "certified business" to encompass various categories, including small, minority, women-owned, veteran-owned, and LGBTQ+ businesses, among others, as certified by the Division of Revenue Business Certification program.
