This bill allows home health care services agencies in New Jersey to employ certified nurse aides as homemaker-home health aides, despite any existing state laws, rules, or regulations that may prohibit this practice. Currently, these agencies are restricted to hiring only certified homemaker-home health aides, while long-term care facilities have the flexibility to employ both types of aides under specific conditions.
To facilitate the implementation of this new provision, the New Jersey Board of Nursing is authorized to adopt necessary rules and regulations in accordance with the Administrative Procedure Act. The bill is set to take effect 90 days after its enactment, although the Board of Nursing may begin preparatory administrative actions beforehand to ensure a smooth transition.
