This bill amends existing law to enhance the responsibilities of State Contract Managers regarding the oversight of subcontractors on State contracts. Specifically, it mandates that State Contract Managers monitor certified businesses identified as subcontractors by prime contractors to ensure they are performing work within their designated areas of expertise. Additionally, if a prime contractor ceases to utilize a certified business as a subcontractor, the State Contract Manager is required to obtain a formal explanation for this change.
Furthermore, the bill requires State Contract Managers to report quarterly to the Chief Diversity Officer on instances where certified businesses are engaged in work outside their expertise. These reports must detail the prime contractor's name, the subcontractor's work description, and the nature of the expertise mismatch. The bill also defines "certified business" to include various categories such as small, minority, women-owned, veteran-owned, and LGBTQ+ businesses, among others, as recognized by the Division of Revenue Business Certification program.
